You agree that all disputes, controversies or claims arising out of or in connection with this Web Site shall be submitted to and be subject to the jurisdiction of the courts of the State of Guerrero, Mexico. You also agree and hereby submit to the exclusive jurisdiction of the courts of the State of Guerrero to finally adjudicate or determine any suit, action or proceeding arising out of or in connection with this Web Site and you do so voluntarily.

International Orders; Prices; Payment Terms; Interest; Credit Cards
The prices for the products and services on this Web Site are quoted, for convenience, in United States dollars, but can be charged in Mexican Pesos or other currencies and shall be as set forth in this Web Site as at the time of acceptance of an order by Medicines Mexico. Prices for Products shall be subject to change without any further notice. Credit terms are within Medicines Mexico sole discretion, and unless otherwise specified in Medicines Mexico invoice, payment must be received by Medicines Mexico prior to Medicines Mexico acceptance of an order. All credit card payments are processed immediately at Checkout in real time. Merchant Bank approval of the transaction funds can take a further 24 to 72 hours after initial processing. Because of same day payment processing, orders cannot be cancelled. Any disputes about Credit Card billing must be discussed with Medicines Mexico before contacting your Credit Card provider. If making payment by Credit Card, you agree not to initiate a "Charge back" dispute against Medicines Mexico for any reason. If you violate this agreement, you agree that we may disable your account and deny any future product orders from you. You further agree to reimburse Medicines Mexico for any costs associated with a charge back which may be charged by the Merchant Banking and or any other service providers to Medicines Mexico.


Consequences
Medicines Mexico reserves the right to suspend or terminate your account if you violate the Terms of Use Agreement. If your violation causes harm to others, you agree to indemnify and hold Medicines Mexico harmless from and against any and all loss, damage, or expense. If any dispute arises between us regarding this Agreement or your use of this Web Site, it shall be resolved through good faith negotiations between the parties. If such efforts prove unsuccessful, all such controversies, claims, or disputes shall be submitted to binding arbitration pursuant to the law and regulations of the State of Guerrero. Arbitration shall be conducted in accordance with the rules of the Mexican Court. The arbitration award shall be final and binding, and it may be confirmed and enforced in any court of competent jurisdiction. Each party shall pay for all attorney fees it incurred in connection with the arbitration and shall share equally in the costs of the arbitration. The venue for any arbitration shall be in the State of Guerrero.

Entire Agreement
These Terms and Conditions and any terms incorporated or referred to herein constitute the entire agreement between Medicines Mexico and you relating to your use of this Web Site and the subject matter hereof, and supersede any prior understandings or agreements (whether electronic, oral or written) regarding the subject matter, and may not be amended or modified except in writing, or by Medicines Mexico making such amendments or modifications in accordance with this Terms and Conditions of Use Agreement.


Sever ability
If any part of this Terms and Conditions of Use Agreement is deemed or determined to be unenforceable, then such part shall be eliminated or limited to the minimum extent necessary. The remainder of this Terms and Conditions of Use Agreement, including any revised portion, shall remain and be in full force and effect. This Terms and Conditions of Use Agreement are the entire agreement between us governing your use of this Web Site.

Force Majeure
Medicines Mexico shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including, without limitation, delays due to backorders of requested products, mail delays, customs delays or lost shipments. Medicines Mexico shall not be responsible to notify the Customer in the event of such delays. The Customer shall be solely responsible to make other arrangements to purchase alternative products and any costs incurred in connection with such purchases.


How long will it take to process my new order or refill and ship my drugs?
Your order may take 72 business hours to process and ship. It takes approx 24-48 hours for your Credit Card or Electronic Check approval to be processed by our Payment Provider. Shipping information and times can be found at the Shipping terms and conditions page.

 

Can my wife/husband’s order be combined and shipped in the same box in order to save on the shipping cost?If you have a significant others in the same household that orders items from us at the same time we will (at your request) ship all the items in the same package and combine shipping charges. Express Shipping is $24.95 USD when ordering online only. FREE SHIPPING promotions are in effect periodically for orders over $275.00 with any quantity of medications.


Do I need a Prescription?
All orders will only be approved with a prescription issued by a licensed Mexican doctor, which is included in the cost. There are no hidden fees. Many medications which require a prescription in the USA or elsewhere are available OTC in Mexico, without prescription. We always recommend customers have a valid prescription from their local physician to ensure correct dosage and medication. We do not sell controlled substances as defined by Mexican authorities, the U.S. DEA and or our payment processing providers banned substances lists.

 

How long will it take for the doctor to review my prescription?
If you have a prescription from your local doctor, keep it in case there are any problems with Customs Importation of your Mexican medicine. We do not sell controlled substances.

 

How often is the list of medications updated?

The price list of items that are quoted on this website is constantly updated. Prices are stated in US Dollars. If you don’t see a drug listed please email your request to our Mexican pharmacy Customer Care center. Please confirm up-to-date prices and drug availabilities. Prices and availability change frequently, and currency conversion rates (to Mexican Pesos) change daily, so we cannot guarantee accuracy of the prices or other content quoted on this website. Sometimes the box presentation of the package may change from the picture, but the item is exactly as ordered.


What do I have to do to order from your company?

What payment options do you accept?
We accept Credit Cards, Electronic Checks payable online (just like writing a check), Bank Wires and Money Transfers. We do not accept any other form of payment. Credit Card and Electronic Check payments are processed via our Secure Payments provider website.

How much can I purchase at one time?
You may purchase for personal use only a maximum of a 90 day supply of each of your medications (up to a maximum 4 medication). You can reorder medications at any time with a separate order/prescription. We recommend you always consult your local Physician before ordering any medications.


How do I initiate the shipment of my refills?
You have the option to order online, email, or call our Customer Care Center and place a new order for refills. Medicines Mexico will not ship refills without the consent and initiating request of the patient electronically. We do not store customer Credit Card information for your safety, so a new payment will be required with each order.


Can Medicines Mexico mail medications?
Yes, we can mail you up to a 90 day supply. There are no restrictions on the number of separate shipments. Please check for updates on the status of U.S. FDA regulations on American Citizen Imports of prescription drugs from foreign countries.


Your prices look great, but what other fees apply?
Our prices are all inclusive, they represent the cost of the medication, the Mexican Pharmacist review, and the Pharmacy dispensing fee. Mexican IVA taxes of 16% are not charged for medications. When comparing our prices with Canadian Discount Pharmacies, remember to include the cost of your doctor visit, prescription, health insurance, Rx Insurance, time mailing and faxing prescriptions etc. which are all required to order from Canada and of course, your loss of medical privacy in the process. There are no other handling fees, drug dispensing fees, or Mexican customs charges.


I have heard that medicines from Mexico are not as good as from Canada or the U.S.?
Not true! Brand name medications are made by the same manufacturers as drugs available anywhere in the world. Generic medicines are the chemical equivalent of brand name drugs (where available) and are made to high quality standards in Mexico. What are the risks of customs seizing orders coming into the US and what are the chances of customs seizing online pharmacy orders coming into the US?
It depends on how conspicuous the packaging is from the pharmacy website, and whether it is known to customs at that port. A reliable online pharmacy will not be known to customs. In the unlikely event that your order is seized you should be sent a polite note from customs informing you of this. It is to our knowledge unheard of for legal action to be taken against individual US citizens importing prescription drugs for legitimate personal use. Customs to stop seizing low-cost prescription drugs imported from overseas.

In a move that cheered buyers of overseas medications, U.S. customs officials told members of Congress they will no longer seize prescription drugs that individuals import from other countries. The new policy, disclosed Tuesday by U.S. Sen. Bill Nelson, D-Fla., ends a controversial practice begun last fall in which the government confiscated or delayed about 40,000 individual medication packages at postal facilities for international mail, including one in Miami serving South Florida. U.S. law forbids importing drugs from other countries, but the government had looked the other way for years. Then on Nov. 17 2005, agents began intercepting drugs from Canada. Budget-conscious seniors, who can save half or more on drug prices by buying from outside the country, protested loudly. Customs officials told members of Congress in an e-mail that as of Monday, agents would no longer handle illegal shipments but would instead pass on information to the Food and Drug Administration. A customs spokeswoman told the Orlando Sentinel that the Bush administration still believes drugs from outside the country pose a higher risk of being counterfeit or adulterated, and about 10 percent of those seized overall have proven to be. The new policy is an internal change, spokeswoman Lynn Hollinger said. "We just decided to focus our resources differently. We are still very committed to protecting the American public from these medications," Hollinger said. South Florida pill buyers said they were relieved the government changed course. "That’s great news," said Diane Cohen, an office manager from Boca Raton, who had a shipment of the breast-cancer drug Tamoxifen from Canada seized in February. "We were being denied the right to purchase medication at a price we can afford." An estimated 1.8 million Americans save money by buying drugs from other countries, especially Canada, which sets price limits as part of its national health system. The customs drug seizures began Nov. 17 2005, two days after the start of enrollment for Medicare’s new prescription drug program. Federal officials said the two were not related, but Democrats in Congress and many seniors suspected the effort aimed to scare them into signing up for coverage. Nelson and other lawmakers pushed legislation that would halt the enforcement, but it became snarled in election-year debate. During the summer, Republican leaders in Congress struck a compromise, saying customs agents would stop seizing drugs that individuals carried back from Canada, but did not address mail-order shipments. The language was written into a budget bill that the House and Senate passed last month. Nelson said he believed the new policy on mailed drugs, coming a month before election day, was a response to pressure from him and others. Charlotte Kammer, owner of CanAm RX Discount Drugs in Sunrise, said the seizures seemed to peak in February, then slowed. Even so, she said a number of storefronts closed this year, partly because of the seizures and partly because seniors switched to the Medicare drug plan. "Some people got scared and stopped ordering. About 5 percent, I’d say," Kammer said. "Now there’s no problem. That’s the best news I’ve heard in a long time." A consumer group that sponsored drug-buying train trips to Canada said the new policy falls short and called on the Bush administration to control drug prices, as Canada does. "The U.S. should be importing Canadian drug policy, not Canadian drugs, so seniors don’t have to cross the border or rely on fly-by-night Internet pharmacies to buy their prescription drugs," said Jerry Flanagan of the Foundation for Taxpayer and Consumer Rights.
